The fact is, a proper audit takes an extraordinary amount of time and you are your best resource when it comes to time. In short, you decide how much effort and energy you want to put into saving your home. For an auditor it is a job, for a lawyer it is billable hours, for you it's your home.

If you have never requested or recieved a full set of documents you signed at closing, your complete servicing loan file, ARM adjustments, escrow accounting, etc, then you will need to start with the webinar on how to make these requests via a RESPA letter and learn other methods of discovery.
If you have never made a demand for true owner of the note, or found your securiitization, than you will need to attend the webinar on how to find your loan in a securitization trust.
It is recommended that you have this information before you conduct a loan audit if time allows you to take these preliminary steps first. You will ge the most out of the loan audit.
Once you find your loan in a securitization trust, you should attend the securitization webinar and learn how to audit the securitization trust.
Only after all of this will you have all the pieces of the puzzle to give yourself the best chance at a resolution. Armed with all the information, you can take your case ready to prosecute to a qualified attorney complete will all your Exhibits organized, and defendants clear. If your state has mediation, you can appear before a mediator with all your documents, Exhibits, and information organized to present your case.
So no matter what your situation, fighting a foreclosure, trying for a loan mod, or litigating a case, you can't have the best possible outcome without a complete loan and trust audit.
ATTORNEYS who ask for a monthly fee. This has become a business model used in that the attorney claims to be keeping you safe, but never does anything proactive to solve your case. Each month they keep the scam going you pay a fee. In the end I have heard from far to many homeowners who were on the verge of losing their home and the same attorney who took a monthly fee drops them or asks them for fees they can't afford claiming all previous payments were exhausted doing work which was never done.
ATTORNEYS who measure success by keeping a homeowner in their home a little longer before foreclosure, and never prosecute or press your case to close the deal, but instead drag it out to suck a monthly fee, they are a scammer. The measure of success should be a resolution, a loan mod, a forbearance, a settlement or judgment in a court of law. Don't be afraid to ask an attorney how many cases they have taken on and what the outcome has been.
AUDITORS who have no history of successful cases where there audits were used. Many auditors reports I have viewed contain so much fluff you could stuff a pillow.
AUDITORS who simply use software programs to check TILA violations.
AUDITORS who know nothing about securitization.
AUDITORS who have lost their own homes to foreclosure.
AUDITORS who will audit your loan file even if you have not requested the lender loan file under a RESPA "QWR" and have no signed set of loan documents. You can't properly audit the loan file unless you obtain all the complete loan file. If the auditor is auditing to determine which documents are missing and gives you a complete discovery list, than that is acceptable only if they will finish the audit when those documents are obtained.
AUDITORS that charge exorbitant fees for public documents claiming they are providing some sort of service such as certifying the records. Recently I discovered a self annointed auditor who charges homeowners $850 just to find a PSA. This is outrageous and a rip off. Don't let this happen to you.
If they are an auditor who charges thousands of dollars and their work product has never been successfully used in any case they can tell you about, they are a probably a scammer.
If the auditors report is about things that don't even matter to your case, they are probably a scammer.
If the auditor was previously a mortgage or real estate broker, many of them are scammers as they put you in these loans, and now they promote saving from them? Truth is they don't care about you, they have just jumped in another abusive industry to prey on vulnerable homeowners.
